Welcome to Musichien. By accessing our website and using our services, you agree to these Terms of Service. These terms constitute a legally binding agreement between you and Musichien.

1. Passive Conduit Disclaimer

Musichien operates solely as a passive technology platform that facilitates connections between Musicians ("Performers") and users seeking to hire them ("Clients"). verified or verified.

• No Employment Relationship: Musichien is not an employer, joint employer, or agent of any Performer. All Performers are independent contractors.
• Direct Contracts: Any booking or contract is directly between the Client and the Performer. Musichien is not a party to any such contract.
• No Guarantee: Musichien does not guarantee the quality, safety, or legality of services advertised, or the ability of Performers to deliver services.

2. Physical Safety & Crime Assumption of Risk

YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE AND ANY OFFLINE INTERACTIONS ARE AT YOUR OWN RISK.

• Sole Responsibility: You are solely responsible for your safety and the protection of your property during any gig or meeting.
• No Liability for Crime: Musichien explicitly disclaims all liability for any act or omission of any User or third party, including but not limited to robbery, theft, assault, battery, stalking, or any other criminal act.
• No Insurance: Musichien does not provide insurance coverage for personal injury, property damage, or theft. You typically should verify if you need your own insurance.
• Risk of Harm: Musichien is not liable for any physical injury, death, or psychological distress resulting from interactions with other users.

3. No-Show & Anti-Fraud Policy

We strive to maintain a reliable community, but we cannot control human behavior.

• Performance Warranty Disclaimer: Musichien makes no warranty regarding the reliability, punctuality, or performance of any User.
• No Liability for Losses: Musichien is not liable for any direct, indirect, or consequential damages resulting from cancelled gigs, no-shows, or poor performance, including lost profits or wasted time.
• Fraud Prevention: While we may use identity verification, we do not guarantee the identity of any user. You are responsible for verifying the identity of parties you interact with.

4. Indemnification (Your Liability)

You agree to release, defend, indemnify, and hold Musichien and its affiliates and subsidiaries, and their officers, directors, employees, and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:

• Your access to or use of the Platform or your violation of these Terms;
• Your interaction with any User or participation in any gig;
• Any injury, loss, or damage (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with a gig or interaction.

Simply put: If Musichien gets sued because of something you did, you agree to pay for our legal defense and any damages.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUSICHIEN SHALL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, SERVICE INTERRUPTION, OR THE COST OF SUBSTITUTE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY.

6. Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Quebec, Canada. Any disputes shall be resolved in the courts located in Montreal, Quebec.
